1. Introduction
Welcome to Curtis Family Vineyards. These Terms of Service (“Terms”) govern your use of our website, online store, and any purchases made through curtisfamilyvineyards.com (the “Site”).
By accessing or using our Site, you agree to be bound by these Terms.
If you do not agree, you must not use the Site.
2. Ownership & Legal Entity
The Site and all associated online sales are operated by:
Tuscany Hills Pty Ltd (Trading as Curtis Family Vineyards) (“we”, “us”, “our”).
3. Eligibility – Alcohol Age Requirements
We sell alcohol and comply with relevant Australian liquor laws.
By placing an order, you declare that:
- You are 18 years of age or older, and
- Any recipient of the order is also 18 years of age or older.
You must not purchase alcohol on behalf of, or supply alcohol to, a minor.
We reserve the right to request proof of age before processing or delivering any order.
4. Your Account
You may create an account to view order history or manage subscriptions.
You are responsible for maintaining the confidentiality of your login details and for all activity occurring through your account.
5. Orders & Acceptance
When you place an order through our Site, you are making an offer to purchase.
We may accept or decline an order for any reasonable reason, including:
- Out of stock items
- Payment authorisation failure
- Regulatory restrictions
- Incorrect or unverifiable customer information
An order is not confirmed until you receive an order confirmation via email.
6. Pricing & Payment
All prices are in Australian Dollars (AUD) and include GST unless stated otherwise.
We accept the following payment methods:
- Shopify Payments
- PayPal
- Afterpay
- Zip
- Apple Pay
- Google Pay
- Credit and debit cards supported by Shopify Payments
Payment must be received in full before dispatch.
We may update prices at any time, but price changes will not affect existing confirmed orders.
7. Subscriptions / Wine Club
We offer subscription products (Wine Club) that automatically renew at the frequency selected at checkout.
By purchasing a subscription, you agree that:
- Your card or payment method will be charged automatically at each renewal period
- Billing occurs prior to dispatch
- You may pause, skip, or cancel your subscription any time before your next billing date
- If your payment fails, our system will attempt to process the charge up to three (3) times
- If payment still cannot be processed, the subscription may be paused or cancelled until updated payment details are provided
You are responsible for ensuring your payment details remain accurate and active.
Subscription boxes that have already been packed or dispatched cannot be returned for change of mind.
Faulty items in subscription boxes remain covered under the ACL.
8. Shipping
Shipping times and delivery windows vary based on your location.
We use trusted third-party carriers such as Australia Post and other logistics partners.
Once your order is dispatched, you will receive tracking information.
You are responsible for ensuring correct delivery details. Fees may apply for incorrect or incomplete addresses, redelivery, or return-to-sender events.

9. Risk & Title
Risk in the goods passes to you once they are delivered to the address provided.
Title passes when full payment has been received.
10. Returns & Refunds (Summary)
Our Returns & Refund Policy forms part of these Terms.
In summary:
- Faulty, damaged, or incorrect items are eligible for a remedy under the ACL
- Change-of-mind returns are accepted within 30 days (unopened items only)
- Subscription boxes already dispatched cannot be returned for change of mind
- Fault assessment may require the product to be returned
- We cover return shipping for faulty goods
- Customers cover shipping for change-of-mind or customer-caused issues

11. Age Verification & Delivery Conditions
Delivery drivers may request identification at the time of delivery.
If ID cannot be produced, delivery may be refused and additional fees (including return-to-sender fees) may apply.
We follow a strict “No ID, No Delivery” policy to comply with Australian liquor laws.
11A. Supplying Alcohol to Minors – Legal Responsibility & Indemnity
By purchasing from our website, you acknowledge and agree that:
- It is illegal in Australia to purchase or supply alcohol to anyone under 18 years of age.
- You are solely responsible for ensuring that the person receiving the order is 18 years or older.
- If you purchase alcohol on behalf of a minor, or provide alcohol to a minor, you may commit a criminal offence and may be subject to prosecution, fines, or other penalties under applicable liquor laws.
Curtis Family Vineyards accepts no responsibility for:
- Any fines, penalties, losses, or legal action arising from a customer’s breach of liquor laws
- Any misuse or unlawful supply of alcohol by the purchaser or recipient
By placing an order, you agree to indemnify and hold harmless Tuscany Hills Pty Ltd (Trading as Curtis Family Vineyards) from any claims, damages, fines, penalties, or legal costs arising from your unlawful purchase or supply of alcohol to a minor.
12. Prohibited Conduct
You agree not to:
- Use the Site for unlawful purposes
- Attempt to interfere with or bypass security features
- Purchase alcohol for anyone under 18
- Provide false or misleading information
- Engage in resale of our products without permission
We may terminate access to the Site for any breach.
13. Intellectual Property
All content on the Site—including text, images, logos, branding, and product descriptions—is the property of Tuscany Hills Pty Ltd (Trading as Curtis Family Vineyards).
